New Delhi Oct 20, 2024: A special bench of Allahabad High Court was constituted on a Sunday evening to hear the PIL moved by Association for Protection of Civil Rights (through its Vice President, UP East, Sayed Mehfuzur Rehman). On behalf of APCR, Advocate Saurabh Shankar Srivastava and Advocate Mohd. Taiyab appeared for the matter.
The bench comprised of Justice Attau Rehman Masoodi and Justice Subhash Vidyarthi. The plea challenged the notices pasted on Mahsi area of Bahraich district, where violence recently took place as a part of which UP government allegedly plans to punitively demolish properties of alleged accused. Keeping the question of maintainability of the petition open, the hon’ble Court issued a notice to the UP government to respond within 3 days from today.
Additionally, the Court granted 15 days breathing time to the potential Bulldozer victim by giving them time to reply to the notices issued to them by PWD, Bahraich.
The Court holds that the UP government will not flout the Supreme Court’s order dated 17th September, which effectively put an interim stay on bulldozer demolitions across India. The struggle for justice and ensuring the right against punitive bulldozer demolition continues.
