Srinagar, May 3 (Zaffer Iqbal): A Court in Uri Wednesday convicted and sentenced a person to six months of imprisonment besides levying a fine double the cheque amount under section 138 of Negotiable Instruments Act (NIA).
As learnt by GNS, a case was filed by one Ali Mohammad Malik son of Habibullah Malik of Nambla Uri against one Ghulam Nabi Shah, son of Yousuf Shah of Nambla Uri under section 138 of Negotiable Instruments Act before Sub-judge Uri.
The learned judge Altaf Hussain Khan, observed that, “Keeping in view the object of Negotiable Instrument Act, the financial gains which cheque amount could have fetched had amount mentioned in the cheques been paid to the complainant by accused on due date as well as the age of the accused and his ailment.”
“Accused is sentenced to simple imprisonment for the period of six months and fine of Rs. 17,20,000 i.e. double the cheque amount, same shall be paid by the accused to complainant within the period of 30 days from the date of this judgment”, the learned judge order while disposing off the case.
